Terms and conditions of sale

I. Definitions

The terms used in these Terms and Conditions have the meanings given below:
1) Proof of Payment – a fiscal receipt, invoice, or bank account statement.
2) User – any person using the Website available at
www.skokibungee.pl and the recipient and user of an e-voucher
3) Customer – a person purchasing a voucher through the online store www.skokibungee.pl
4) Voucher and E-voucher –a form of confirmation of the agreement concluded between the User/Customer and Bungy Kraków sp. z o.o., granting the Voucher Holder the right to use the Service provided by Bungee Jumping Kraków – bungee jumping. Vouchers and E-vouchers are distributed in various forms:

• E-voucher – an electronic voucher that you can print yourself. It is delivered as a PDF file to the email address provided by the User.
• Voucher – ready to give The voucher can be ordered via the website www.skokibungee.pl or purchased directly at the Bungee Jumping Kraków rubber rope jumping center at Al. Pokoju 16, 31-564 Kraków.
  

5) Voucher Holder – a person in possession of a Voucher or E-voucher entitling them to use the Service.
6) Service – a bungee jump provided to the Voucher Holder by Bungee Jumping Kraków.
7) Terms and Conditions – these Terms and Conditions for the distribution of Vouchers and E-vouchers for bungee jumping services provided by Bungee Jumping Kraków.
8) Website www.skokibungee.pl – an online system for the distribution of Vouchers and E-vouchers, available at www.skokibungee.pl. The website enables the processing of orders, payments, and collection of Vouchers and E-vouchers
9) Bungee Jumping Kraków – an entrepreneur operating under the name Bungy Kraków Sp. Z o.o. , Al. Pokoju 16, 31-564, Kraków, providing services in Kraków, at al. Pokoju 16, with NIP: 675-181-62-19

II. General Provisions

1. The regulations are effective as of November 1, 2025.
2. The Terms and Conditions contain provisions regarding the distribution of Vouchers and E-vouchers using the www.skokibungee.pl website and the bungee jumping facility, Bungee Jumping Kraków, located in Kraków at al. Pokoju 16.
3. Before purchasing a Voucher or E-voucher at www.skokibungee.pl/sklep, you are required to read the Terms and Conditions and comply with their provisions.
4. Before purchasing the Service, the Customer/User, as well as the Holder of a Voucher or E-voucher, is obliged to read the Terms and Conditions of Bungee Jumping in Krakow and comply with its provisions. The Terms and Conditions referred to in the previous sentence specify the detailed conditions for the provision of the Service, including the rights and obligations of the parties and restrictions on the provision of the Service. Vouchers and E-vouchers are valid for 12 months.
5. Validity of Vouchers and E-vouchers is calculated from the date of payment and activation.
6. The date of payment is considered to be:

• the day the required amount is credited to the Bungee Jumping Kraków bank account;
• the day of making a cash payment to an employee of the Bungee Jumping Kraków bungee jumping center in Krakow at al. Pokoju 16.
  

III. Terms of use

1. Bungee Jumping Kraków provides Users of the Website, available at www.skokibungee.pl, with the exercise of rights arising from:
   1) the Act of May 30, 2014, on consumer rights (Journal of Laws of 2017, item 683, as amended);
   2) the Act of August 29, 1997 on the protection of personal data (Journal of Laws of 2016, item 922, as amended);
   3) the Act of July 18, 2002 on the provision of electronic services (Journal of Laws of 2017, item 1219, as amended).
2. The process of selling Vouchers or E-vouchers via the www.skokibungee.pl website consists of the following steps:
   1) selecting an offer and adding it to the basket;
   2) registering or logging in to the Website (optional);
   3) selecting the method of delivery of the Voucher or E-voucher;
   4) selecting the method of payment for the Voucher or E-voucher.
3. Both registered and unregistered Users can purchase Vouchers or E-vouchers via the www.skokibungee.pl website. In this case, an email address is required.
4. To purchase Vouchers or E-vouchers via the www.skokibungee.pl website, the Customer must place an order specifying the number of Vouchers or E-vouchers to be purchased and confirm the order by clicking on the "Buy and pay" button .
5. Once a valid order has been placed, the customer will receive an order confirmation via email with information about the acceptance of the order, the amount to be paid and the
   payment option.
6. Voucher delivery methods available at www.skokibungee.pl are:
   1) E-voucher - PDF file sent electronically to the indicated e-mail address
   2) personal collection at Bungee Jumping Krakow al. Pokoju 16.
7. The condition for purchasing a Voucher or E-voucher is prepayment of the entire amount corresponding to the price of the Service or its multiple on the day of ordering.
   1) Payment for the purchase of Vouchers or E-vouchers via the www.skokibungee.pl website can be made via the Paynow online payment system – an option for Users who have access to electronic banking (suggested form of payment);
   2) cash payment – made to an authorized employee of the Bungee Jumping Kraków bungee jumping center in Krakow at al. Pokoju 16.
8. The entity providing online payment services for card payments is Autopay S.A. Available payment methods:
   • BLIK
   • Online transfers
   • Payment cards:
     • Visa
     • Visa Electron
     • Mastercard
     • MasterCard Electronic
     • Maestro
9. Booked but unpaid orders expire after 7 calendar days and are automatically deleted from the system after that time.
10. It is possible to issue a duplicate Voucher or E-voucher, in the form and manner determined by Bungee Jumping Kraków, upon prior presentation of Proof of Payment by the User/Customer, and provided that the Voucher has not yet expired.

IV. Activation

1. Vouchers and e-vouchers are secured with a unique coupon number. This number can be used to determine the value, status, and validity period of the voucher. A voucher can only be used once, after activation, which occurs automatically upon payment for the order.
2. The validity of Vouchers or E-vouchers referred to in point II.5. is always calculated from the date of order fulfillment, which is the date of payment and activation.
   

V. Implementation of the Service

1. Vouchers and e-vouchers are not personalized documents and do not include prices. To redeem them, you only need to present them just before the service is provided at the Bungee Jumping Kraków service point, al. Pokoju 16.
2. The holder of a Voucher or E-voucher may use the Service on a date convenient for them. In order to use the Voucher or E-voucher, please arrive without a reservation at the Bungee Jumping Kraków service point, al. Pokoju 16, during the opening hours of the point.
3. The holder of a Voucher or E-voucher is required to present the Bungee Jumping Krakow Voucher or printed E-voucher with a legible voucher number.
4. Bungee Jumping Kraków may require proof of date of birth, and the Voucher or E-voucher Holder is required to present it.
5. If the documents referred to in section 4 are not presented at the express request of Bungee Jumping Kraków, Bungee Jumping Kraków may refuse to provide the Service. In such a situation, the Voucher or E-voucher Holder shall not be entitled to any compensation or reimbursement of costs incurred.
6. Bungee Jumping Kraków may change the date or refuse to provide the Service in whole or in part for reasons beyond its control, after informing the Voucher or E-voucher Holder of the circumstances.
7. Independent causes are circumstances over which Bungee Jumping Kraków has no control and which prevent the provision of the Service. In particular, these include:
   1) unfavorable weather conditions;
   2) technical failures or damage to devices and equipment;
   3) the health condition of the Voucher or E-voucher Holder;
   4) decisions of public authorities;
   5) unforeseen accidents.
8. In the cases specified in point 6, the Voucher or E-voucher Holder has the right to set a different date for the performance of the Service or exchange the voucher for another service at Bungee Jumping Kraków.
9. Due to generally applicable regulations and the need to maintain safety during the provision of services, Bungee Jumping Kraków has the right to:
   1) refuse to provide the Service to persons under the influence of alcohol or intoxicating substances;
   2) request that the person leave the area where the Service is provided and take appropriate steps to ensure that this request is complied with in situations where the Voucher or E-voucher Holder disturbs public order, behaves aggressively or in a manner inconsistent with the Terms and Conditions
   of Bungee Jumping Kraków.
   3) prohibit the bringing of alcohol, intoxicants, or other items or substances that may pose a threat to the safety of persons
   or whose bringing may be contrary to the Terms and Conditions of Bungee Jumping Kraków or other generally applicable laws.
10. In the cases specified in section 9, the Holder of a Voucher or E-voucher shall not be entitled to claim any compensation, reimbursement of costs incurred, or damages.
    

VI. Voucher or E-voucher exchange

1. Vouchers or E-vouchers can be exchanged within 12 months from the date of activation, under the following conditions:
   1) exchange for a Voucher or E-voucher entitling the holder to a more expensive service, after paying the difference in price;
   2) exchange for a Voucher or E-voucher entitling the holder to a service of the same or lower value.
   3) The Voucher or E-voucher must be active during the exchange.
2. The Voucher can be exchanged for any Service available on the website www.skokibungee.pl, other than the exchanged Service.
3. The exchanged Voucher or E-voucher retains the expiration date of the Voucher or E-voucher before the exchange.
4. Vouchers or E-vouchers that have been purchased through exchange and Vouchers that have expired cannot be exchanged.
5. The voucher can be exchanged at the Bungee Jumping Krakow service point, al. Pokoju 16, 31-564, Krakow, during the opening hours of the point.
   

VII. Consumers' right to withdraw from the contract

1. A Customer who is a consumer within the meaning of Article 221 of the Civil Code – who purchased a Voucher or E-voucher via the www.skokibungee.pl website is entitled to withdraw from the contract without giving reasons and without incurring costs, by submitting a relevant written statement to Bungee Jumping Kraków and returning the purchased Voucher or E-voucher within 14 days of receipt. To meet the deadline, it is sufficient to send the statement before its expiry.
2. The consumer may also withdraw from the contract using the model withdrawal form or by submitting a statement on the website www.skokibungee.pl
3. Upon receipt of the statement of withdrawal from the contract, Bungee Jumping Kraków shall immediately invalidate the purchased Voucher or E-voucher, send the Consumer an electronic confirmation of receipt of the statement, and refund the payment received from the Consumer within 14 days of receipt of the statement to the account indicated by the Consumer.
   

VIII. Complaints

1. In the event of a defect in the Bungee Jumping Kraków service, Bungee Jumping Kraków shall be liable for any defects found in accordance with the provisions of the Civil Code.
2. The customer shall immediately notify Bungee Jumping Kraków of any defect found by email – to biuro@skokibungee.pl or in person – at the Bungee Jumping Kraków service point, al. Pokoju 16.
3. In connection with the complaint, the customer may demand: performance of the service free from defects or a reduction in the price paid, or may withdraw from the contract and demand a refund of the price paid.
4. Bungee Jumping Kraków is obliged to confirm receipt of the complaint by email, sending the Customer confirmation and responding to the complaint within 14 days of its delivery, and to inform the Customer by email within that period of how it has been resolved.
5. In the case of price reduction or withdrawal from the contract, Bungee Jumping Krakow shall transfer the amount due within 14 days from the date of acceptance of the complaint by wire transfer to the account indicated by the Customer.

IX. Data protection and privacy policy

1. Bungee Jumping Krakow is the administrator of the personal data of Users/Customers.
2. By registering or logging in to the www.skokibungee.pl website, the User/Customer consents to the processing of their personal data provided in the registration form by Bungee Jumping Kraków. Providing personal data by the User/Customer is voluntary, however, failure to consent to the processing of personal data may prevent the provision of electronic services and the Customer
   from making purchases on the Website www.skokibungee.pl.
3. Bungee Jumping Krakow is authorized to process personal data for the purpose of contract performance and direct marketing of its own services.
4. Customers have the right to request Bungee Jumping Kraków to supplement, update, rectify personal data, temporarily or permanently suspend its processing, or delete it if it is incomplete, outdated, untrue, or has been collected in violation of the Personal Data Protection Act, or is no longer necessary for the purpose for which it was collected.
5. Bungee Jumping Kraków is authorized to disclose personal data administered by it only to authorities authorized under generally applicable laws.
6. Bungee Jumping Kraków uses cookies, which contain information necessary for the proper functioning of the www.skokibungee.pl website, in particular for the authorization process and remembering personal settings. Cookies are not used to process or store personal data.
   

X. Liability

1. Bungee Jumping Krakow shall be liable to Users/Customers
   under the rules set forth in the Civil Code.
2. Bungee Jumping Kraków is directly responsible for the conduct, quality and safety during the provision of the Service. All risks concerning the User/Customer related to the performance of the Service are described in the Rules and Regulations of Jumping on Rubber
   Bungee Rope / Bungee Jumping Krakow and are charged to Bungee Jumping Krakow.
3. Failure to use the Voucher or E-voucher during its period of validity shall result in the Holder's resignation from the possibility of performing the Service and the expiry of all rights related to the concluded contract. The Holder of the Voucher or E-voucher shall not be entitled to demand any compensation, reimbursement of costs incurred, or damages.
4. Bungee Jumping Kraków is not responsible for Vouchers or E-vouchers that have been destroyed or lost, or for their use by an unauthorized person who has come into possession of them, if this event occurred after they were handed over to the User/Customer.
   

XI. Other provisions

1. In matters not regulated by the Regulations, the provisions of Polish law, including the Civil Code of the Act on Consumer Rights shall apply.
2. With regard to all matters related to a given order, the Terms and Conditions in force on the date of placing the order shall apply.
3. In the event of disputes with the User/Customer, Bungee Jumping Kraków
   shall endeavor to resolve the matter amicably. The court competent to hear any conflicts that arise shall be the common court competent under the applicable law.
